**Willowhound Dog Training

Terms and Conditions of Service**

These Terms and Conditions (“Terms”) apply to all services provided by Willowhound Dog Training (“Willowhound”, “we”, “us”, “our”). By booking, paying for, or receiving services, the client (“Client”, “you”, “your”) agrees to be bound by these Terms.


1. Definitions

Dog means any dog owned or controlled by the Client and presented for services.
Services means Dog Walking Services, Training Services, and Pet Sitting or Home Stay Services as defined below.
Premises means the physical location at which Services are provided, including the Client’s premises, public spaces, or Willowhound’s premises where applicable.


2. Acceptance of Terms

2.1 These Terms constitute a legally binding agreement.
2.2 Acceptance occurs by booking, payment, written or electronic confirmation, or by conduct.
2.3 Continued use of Services constitutes ongoing acceptance of these Terms.


3. General Client Obligations

3.1 The Client warrants that they are the legal owner or authorised guardian of the Dog.
3.2 The Client must provide accurate and complete information regarding the Dog’s health, behaviour, training history, triggers, medications, and risks.
3.3 Any failure to disclose relevant information constitutes a material breach of these Terms.
3.4 The Client must immediately notify Willowhound of any changes to the Dog’s health, behaviour, or environment.


4. Veterinary and Emergency Authority (All Services)

4.1 Willowhound is authorised to seek veterinary treatment where reasonably required if the Client cannot be contacted.
4.2 All veterinary, emergency, transport, medication, and follow-up costs are the sole responsibility of the Client.
4.3 Willowhound is not responsible for the outcome of veterinary decisions unless caused by proven negligence.


5. DOG WALKING SERVICES

5.1 Scope

Dog walking services include leash walking, structured movement, enrichment, and basic training activities conducted in public or agreed locations.

5.2 Access

5.2.1 Dog walking services may require access to the Client’s premises for pick up and return.
5.2.2 The Client must provide safe, secure access instructions.
5.2.3 Willowhound is not responsible for security failures beyond reasonable control.

5.3 Behaviour and Risk

5.3.1 The Client acknowledges the inherent risks of public walking, including encounters with other dogs, people, traffic, wildlife, and environmental hazards.
5.3.2 Willowhound may modify or cease a walk if safety or welfare is compromised.
5.3.3 The Client accepts full responsibility for any injury, damage, or incident caused by the Dog during walks.

5.4 Feeding and Treats

5.4.1 Dogs must not be fed a large meal prior to walks.
5.4.2 Willowhound may provide single protein treats unless otherwise instructed.

5.5 Weather

5.5.1 Walks may be shortened, modified, or replaced with lower intensity activities during extreme weather to prevent heat or cold stress.

5.6 Cancellations

5.6.1 Walk cancellations require 12 hours notice.
5.6.2 Late cancellations may be charged in full.


6. TRAINING SERVICES

6.1 Scope

Training services include private sessions, behaviour modification, handling exercises, and education provided at the Client’s premises, public locations, or agreed premises.

6.2 No Guaranteed Outcomes

6.2.1 Training outcomes are not guaranteed and depend on consistency, environment, and Client participation.

6.3 Client Responsibility

6.3.1 The Client remains responsible for the Dog at all times unless explicitly agreed otherwise.
6.3.2 Willowhound is not responsible for regression, non-compliance, or behavioural changes outside of sessions.

6.4 Payment

6.4.1 Individual training sessions are payable on the day of service.
6.4.2 Training packages must be paid in full prior to commencement.

6.5 Liability

6.5.1 Training may involve exposure to triggers, handling, or controlled stressors.
6.5.2 The Client assumes all risks associated with training activities.


7. PET SITTING AND HOME STAY SERVICES

7.1 Scope

Pet sitting and home stay services involve care of the Dog at Willowhound’s premises for agreed periods.

7.2 Access

7.2.1 No access to the Client’s premises is required for home stay services unless pickup or drop off has been arranged.
7.2.2 Where pickup or drop off is required, access provisions apply only for that purpose.

7.3 Integration and Environment

7.3.1 Dogs may be integrated into a shared environment with other dogs where appropriate.
7.3.2 Willowhound reserves the right to separate dogs if required for safety or welfare.

7.4 Property Damage

7.4.1 The Client accepts that Dogs may cause damage through normal or stress-related behaviours.
7.4.2 The Client agrees to be responsible for damage caused by their Dog to Willowhound’s premises, fixtures, furnishings, or property.


8. Payments for Pet Sitting and Home Stays

8.1 A 20 percent deposit is required to secure all home stay and pet sitting bookings.
8.2 The remaining balance is payable after completion of the booking unless otherwise agreed.


9. Home Stay and Pet Sitting Cancellations

9.1 Cancellations made more than 7 days prior to the commencement of the booking will receive a full refund of the deposit.
9.2 Cancellations made between 72 hours and 7 days prior will result in the deposit being retained.
9.3 Cancellations made within 72 hours will result in the deposit being retained and Willowhound reserves the right to charge up to 50 percent of the total booking fee.
9.4 No refunds are provided for early returns or shortened stays.


10. Assumption of Risk

10.1 The Client acknowledges and accepts all inherent risks associated with dog walking, training, transport, handling, and pet sitting services.


11. Indemnity

11.1 The Client indemnifies Willowhound against all claims, losses, liabilities, damages, or costs arising from:
a) the Dog’s behaviour
b) injury or damage caused by the Dog
c) inaccurate or incomplete disclosures
d) third party claims


12. Limitation of Liability

12.1 To the maximum extent permitted by law, Willowhound’s liability is limited to resupplying the Services or refunding the affected portion paid.
12.2 Willowhound is not liable for indirect or consequential loss.


13. Australian Consumer Law

13.1 Nothing in these Terms excludes rights under Australian Consumer Law that cannot be excluded.
13.2 Where permitted, liability is limited as stated.


14. Force Majeure

14.1 Willowhound is not liable for delays or failure due to events beyond reasonable control.


15. Termination

15.1 Willowhound may terminate Services immediately where safety, welfare, or payment concerns arise.
15.2 Outstanding fees remain payable upon termination.


16. Amendments

16.1 Willowhound may amend these Terms at any time.
16.2 Continued use of Services constitutes acceptance of amended Terms.


17. Governing Law

17.1 These Terms are governed by the laws of New South Wales, Australia.
17.2 The parties submit to the exclusive jurisdiction of NSW courts.

By booking Services, the Client confirms they have read, understood, and agreed to these Terms and Conditions in full.
